Procedure to apply for Marriage Certificate in west Bengal-
In West Bengal, Marriage can be registered under Hindus Act 1955 or Special Marriage Act 1954.
A. Hindu Marriage Act-
Hindu Marriage Act applies to those who are Hindu by religion in any if its forms and developments including Virashaiba, Lingayat or a follower of Brahmo Prathana or Arya Samaj. It also applies to Buddhist, Jaina or Sikh By religion.
For registration under Hindu Marriage Act, marriage may solemnized between two Hindus and must satisfy the conditions prescribed in it. Application for the registration under Hindus Act can be made by any of the parties to marriage at the office of registered office.
B. Special Marriage Act-
For solemnization if marriage under Special Marriage Act 1954, either of bridegroom or bride on attaining the prescribed age before the marriage officer in whose jurisdiction either of them resides. After one month and within 3 months of submission of such application, both the bridegrooms and bride shall have to appear before the marriage officer along with the 2 witness. If objections are not filed by anybody against the solemnization of marriage then Marriage officer will solemnize the marriage.
